Terms of Service

1. Agreement

These Terms govern your use of PixelMind AI. By using the Platform, you agree to them and the linked policies. For questions about these Terms, contact support@mypixelmind.com.

2. Eligibility and accounts

You must be at least 18 and legally able to enter a contract. Keep account credentials secure, provide accurate information, and promptly report unauthorized access. Accounts may not be sold or transferred.

3. Service

PixelMind provides AI image/video generation, editing, storage and optional community publishing through PixelMind and third-party models. Models, availability and processing times can change. We may modify or discontinue features, but material changes affecting a paid service will be handled consistently with applicable consumer law.

4. Credits, prices and subscriptions

• Free accounts currently receive 25 Fast Mode credits daily; unused daily credits expire at midnight UTC. Displayed fair-use Slow Mode limits also apply.
• Subscription credits refresh on the account’s subscription credit-cycle date and do not roll over.
• Top-up credits expire six months after purchase and are consumed after subscription credits.
• Model costs vary by output count, resolution, duration, audio and settings. The confirmed cost shown before submission controls.
• Subscriptions renew for the selected monthly or annual term until cancelled. Cancellation takes effect after the paid billing period.

Creem is Merchant of Record and handles checkout, tax, payment details, refunds and chargebacks. Available payment methods are shown at checkout and vary by customer and device.

5. Acceptable use

You may not use the Platform for illegal activity, sexual exploitation, non-consensual intimate content, credible threats, hateful abuse, fraud, deceptive impersonation, political manipulation, privacy violations, malware, infringement, or attempts to bypass safety and rate limits. You must have the necessary rights and consent for every prompt, upload, likeness, trademark and other source material.

6. Inputs, outputs and intellectual property

• You keep whatever rights you already hold in your inputs and grant us and selected providers a limited license to process them to deliver, secure and support the service.
• As between you and PixelMind, we do not claim ownership of your output. Paid plans permit commercial use subject to these Terms and third-party rights.
• We do not guarantee that an output is unique, copyrightable, non-infringing or free of third-party rights. Similar outputs may be produced for others.
• You are responsible for reviewing outputs and obtaining legal advice before consequential or commercial use.
• Publishing a work grants PixelMind a non-exclusive license to display and distribute it until you unpublish or delete it, subject to reasonable backup retention.

7. Feedback and testimonials

Ratings and private comments may be used to improve the service. We will not present a private comment as a public testimonial without separate approval. Public testimonials must reflect a genuine user experience and may be removed on request.

8. Refunds and withdrawal rights

Contact support with the order ID for duplicate charges, billing errors or other refund requests. Creem processes approved refunds. Digital services and credits may be supplied immediately after purchase. Where law requires it, checkout will request express consent to immediate performance and acknowledgement of any resulting loss of a withdrawal right. Nothing here limits mandatory refund, cancellation or consumer rights.

9. Suspension and deletion

We may remove content or restrict accounts when reasonably necessary for security, legal compliance, non-payment or policy violations. Where practical, we will provide notice and an opportunity to appeal. You may delete your account in Profile settings; some payment, tax, backup and abuse-prevention records may be retained when legally necessary.

10. Disclaimers and liability

The Platform and AI outputs are provided “as is” to the extent permitted by law. We do not guarantee uninterrupted service, model availability, factual accuracy or fitness for a particular purpose. We do not exclude liability that cannot lawfully be excluded. Subject to that rule, our aggregate liability arising from a paid service will not exceed the amount you paid for that service during the 12 months before the claim.

11. Disputes

Contact support first so we can try to resolve a dispute. Creem’s terms also apply to payment transactions. Nothing in these Terms limits mandatory consumer protections that apply to you.

12. Changes and contact

We may update these Terms. Material changes will be announced through the Platform or account email before they take effect where required. Contact support@mypixelmind.com.
